Investigation of a Legal Problem Legal studies Work requirement 3 Recently I bought a Wedgwood 42-piece dinner-set from 'Bobs Fine Tableware Store' valued at $3500. It was delivered to me and when the sales assistant left I opened it up to find that a lot of the plates and cups were scratched and the gold pattern around the edge of the plate had faded in some parts. I rang up the sales assistant. "Hello Bobs fine tableware store how can I help you" "Hello this is Mark Lavery , I bought a dinner set off you yesterday and when I opened it , it was all scratched up and all the gold pattern had faded and I was wondering if I could get a replacement" "No I'm sorry but it was fine when it left the shop I cant give you a replacement" "Ok then I'll just have my money back then" "I cant do that either , your dinner set was in perfect condition when it left the shop you must have done something to it" "I didn't do anything to it , I even asked you when you were at the door to open it and check that it was the right one and it isn't because I wanted one that wasn't scratched and faded" "Well sorry but theirs nothing I can do so if there is nothing else , I've got a lot of work to do" "This isn't the last you have heard of me" The next day I rang the equal opportunities board. "Hello this is Mark Lavery and I was just ringing up to get a bit of information" "Yes how can I help you" "Well I recently purchased a new dinner set , but when it was delivered it was all scratched and faded. So I asked for a replacement or my money back but the shop owner refused saying that I must have done something to it". "And I was wondering if I could do anything about this". "Well what I suggest is that you take this to the small claims tribunal which is where people can settle 'small claims' outside of court for a fraction of the cost and time". "What do I need to do?" "Well first you have to telephone the shop owner of your complaint , if that is ignored you write a formal letter of complaint and if that doesn't work you go to the small claims tribunal with your complaint".
